CLARENCE FIRE DISTRICT NO.1
OF CLARENCE, NEW YORK

Please take notice that the Annual Election of Clarence Fire District #1 will take place on Tuesday, December 8, 2009 between the hours of 6:00 PM and 9:00 PM at the Clarence Fire Hall, located at 10355 Main St., Clarence, NY, for the purpose of electing a Fire Commissioner. The position shall be for a period of five years, commencing on January 1, 2010 and ending December 31, 2014.

Please note that only residents who are registered with the Erie County Board of Elections on or before November 16, 2009 are eligible to vote.

Having received the 2009-2010 School Tax Warrants dated September 1, 2009 for the Clarence Central School District, the Williamsville Central School District and the Akron Central School District, Nancy C. Metzger, Town Clerk of the Town of Clarence announces the following:

Taxes may be paid Monday through Friday from 9:00 A.M. until 5:00 P.M. at the Town Clerk's Office, One Town Place, Clarence, New York; by mail to Nancy C. Metzger, Town Clerk, Town of Clarence, P.O. Box 3187, Syracuse, NY 13220-3187; or at any Bank of Akron location – 9470 Clarence Center Rd., Clarence Center; 9865 Main St., Clarence; 46 Main St., Akron; 77 Buell St., Akron.

A night deposit box is available to the right of the front entrance at the Town Hall.

Payments made by October 15th are free of penalties. From October 16th through November 2nd, 7.5% penalties are charged. From November 3rd through November 30th, 9.0% penalties including interest are charged.

Tax Rates per One Thousand Dollars of Assessed Value are as follows: Clarence Central - $14.237198; Williamsville Central - $17.164376; and Akron Central - $14.816023.

PLEASE TAKE NOTICE, that on August 12, 2009, the Town Board of the Town of Clarence, adopted a resolution entitled:

"RESOLUTION OF THE TOWN OF CLARENCE, NEW YORK,
ADOPTED AUGUST 12, 2009, APPROVING THE ESTABLISHMENT
OF SEWER DISTRICT NO. 4 IN SAID TOWN, AND PROVIDING
THAT SUCH RESOLUTION SHALL BE SUBJECT TO PERMISSIVE
REFERENDUM".

an abstract of such resolution, concisely stating the purpose and effect thereof, being as follows;

FIRST: RECITING that the Town Board of the Town of Clarence ("Town Board" and "Town", respectively), in the County of Erie, New York, has heretofore duly caused the preparation of a map, plan and report for the proposed establishment of Sewer District No. 4 ("District"), which map, plan and report have been duly filed in the office of the Town Clerk of the Town for public inspection; that an Order was duly adopted by the Town Board on July 8, 2009, reciting the filing of the map, plan and report, a description of the boundaries of the proposed District in a manner sufficient to identify the lands included therein, the services proposed, that the expense of creating the District is to paid for by the developer of the Spaulding Green Subdivision and at no capital cost to the Town, and specifying the time and place of a Public Hearing to hear all persons interested in the subject thereof concerning the same; that the costs of the operation and maintenance by the District will be paid by the assessment, levy and collection of assessments upon the several lots and parcels of land within the District which the Town Board shall deem especially benefited by said facilities so much upon and from each as shall be in just proportion to the amount of benefit which the improvement shall confer upon the same, that copies of such Order were duly published and posted, and that such hearing was duly held on August 12, 2009, at the time and place specified;

SECOND: RESOLVING AND DETERMINING that a) the Notice of Hearing was published and posted as required by law and is otherwise sufficient, b) all the property and property owners included within the District are benefited thereby, c) all the property and property owners benefited are included within the limits of the District and d) that the establishment of the District is in the public interest;

THIRD: APPROVING the establishment of the District and the supplying of the services proposed and describing the District in a manner sufficient to identify the lands included therein; and

FOURTH: RESOLVING that the establishment of the District will be of no cost to the Town but the costs of the operation and maintenance by the District will be paid by the assessment, levy and collection of assessments upon the several lots and parcels of land within the District which the Town Board shall deem especially benefited by said facilities so much upon and from each as shall be in just proportion to the amount of benefit which the improvement shall confer upon the same with current average EDU rate for residents in other Town of Clarence Sewer Districts receiving sewer service being $268.81 per year which is the estimated cost to a typical property for sewer service within the District.

FIFTH: STATING that this resolution is subject to permissive referendum.

A copy of the report, for the year ended December 31, 2008, entitled Basic Financial Statements and Additional Information with Independent Auditor's Report, internal control related matters letter and report to the Board prepared in conjunction with the audit of the Basic Financial Statements have been filed in my office where they are available as a public record for inspection by all interested persons at the Town Clerk's Office, One Town Place, Clarence, New York during normal business hours, Monday through Friday from 9:00 a.m. to 5:00 p.m.

Pursuant to section thirty-five of the General Municipal Law, the Town Board of the Town of Clarence, New York may, in its discretion, prepare a written response to these audits and file any such response in my office not later than August 6, 2009 as a public record for inspection by all interested persons.

TOWN OF CLARENCE
LEGAL NOTICE

Please take notice that the undersigned Town Clerk for the Town of Clarence received the Tax Rolls and Warrant for the collection of taxes for the year 2009 and will receive payment for the same on the following basis:

No fee will be charged on taxes paid on or before February 17, 2009.

Penalties will be added as follows:

February 18 - March 2 Inclusive       1½ percent
March 3 - March 16 Inclusive           3 percent
March 17 - March 31 Inclusive         4 ½ percent
April 1 - April 15 Inclusive                6 percent
April 16 - April 30 Inclusive              7½ percent

On May 1, 2009, the 7½ percent penalty fee is added to the Levy (original amount), forming the base of the tax then due. Thereafter, interest is added to the base at the rate of 1½ percent per month on the first of each month, making 18.78 percent in all when taxes are sold in November 2009.
