Kennedy Says New Federal Policy Validates Need for Widespread Texting Rules

Local Author of Texting Ban Notes National Attention on Dangers

Erie County Legislator Tim Kennedy, lead sponsor of a Local Law banning text messaging while driving in Erie County, cited new federal policies expected to be announced today (Tuesday, January 26) by the United States Department of Transportation (USDOT) as laudable progress in the fight for widespread recognition of the dangers of texting while driving.

Federal Transportation Secretary Ray LaHood has been a vocal advocate for tougher restrictions on texting while driving and will be announcing a new rule that bans the practice for truck and bus drivers, effective immediately.

"This new policy, and laws such as the ALERT bill introduced by Senator Schumer, recognize a crucial need for the federal government to address the dangers of text messaging while driving and are a commendable first step," stated Legislator Kennedy. "But, it is only the first step of many. As author of a Local Law here in Erie County, and given the growing dangers of texting while driving, I know that we must go further if we are going to ensure the safety of drivers, passengers, and every traveler on the roads today."

An industry report indicates that wireless devise usage is growing exponentially with 276 million wireless users texting 4.1 billion messages per day on average in 2009, twice as much as the previous year. Legislator Kennedy noted that the National Safety Council estimates that 28% of crashes -- 1.6 million crashes per year -- can be attributed to cell phone talking and texting while driving.

On Oct. 22, 2009, the Erie County Legislature unanimously approved a measure sponsored by Legislators Kennedy and Tim Wroblewski that would allow local police to stop and ticket drivers who text while operating a motor vehicle. This measure makes text messaging while driving a primary offense, which allows authorities fine any driver, commercial or otherwise, for committing this offense.

Erie County's Local Law classifying texting while driving as a primary offense is stronger than that passed in Albany, which classifies it as a secondary offense and only punishable if done during the commission of another offense, such as speeding.
