PLEASE TAKE NOTICE, that a public hearing of the Newstead Town Board will be held at the Newstead Town Hall, 5 Clarence Center Road, in the Village of Akron, New York at 7:50PM on Monday, May 11, 2009 to consider site plan approval for the following:
Request from Michael Shields to construct a 2,520 sq. ft. pole barn at 12690 Main Road.
The hearing is open to the public. Interested individuals may submit written comments in advance of the public hearing. The meeting room is handicapped accessible. Those needing special arrangements should call the Town Clerk at the Town Hall at 542-4573 within 5 (five) days of the hearing date.

PLEASE TAKE NOTICE, that there has been presented to the Town Board on March 9, 2009, for adoption a proposed Local Law to be known as "Local Law No. 1 of the Year 2009" entitled "Amendment to the Subdivision Law of the Town of Newstead". The proposed Local Law will amend the Subdivision Law add back in the old definition of Major Subdivision and Minor Subdivision as was contained in the Code prior to the amendment to the Subdivision Law adopted at the time of the re-adoption of the Code.
THEREFORE, pursuant to the Municipal Home Rule Law Rules and Local Law No. 1 of the Year 2009, the Town Board of the Town of Newstead shall hold a Public Hearing on the aforesaid Local Law at the Town Hall, 5 Clarence Center Road, Akron, New York at 7:50 p.m. on the 27th day of April, 2009, at which time persons interested may be heard. Copies of the aforesaid proposed Local Law are available at the office of the Town Clerk for inspection and distribution to any interested person during business hours. The meeting room is wheel chair accessible. Those needing special arrangements should call the Town Hall at 542-4573 by April 22, 2009.

PLEASE TAKE NOTICE, that there has been presented to the Town Board on March 23, 2009, for adoption a proposed Local Law to be known as "Local Law No. 2 of the Year 2009" entitled "Amendment to the Zoning Law of the Town of Newstead". The proposed Local Law will amend that portion of the Zoning Law dealing with site plan approval to provide for time limitations for construction and completion of work following receipt of site plan approval to ensure that new construction conforms with the Code of the Town of Newstead as amended from time to time..
THEREFORE, pursuant to the Municipal Home Rule Law Rules and Local Law No. 2 of the Year 2009, the Town Board of the Town of Newstead shall hold a Public Hearing on the aforesaid Local Law at the Town Hall, 5 Clarence Center Road, Akron, New York at 7:45 p.m. on the 27th day of April, 2009, at which time persons interested may be heard. The resolution, a summary of which is published herewith, has been adopted on January 26, 2009 and the validity of the obligations authorized by such resolution may be hereafter contested only if such obligations were authorized for an object or purpose for which the Town of Newstead, in the County of Erie, New York, is not authorized to expend money or if the provisions of law which should have been complied with as of the date of publication of this Notice were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the publication of this Notice, or such obligations were authorized in violation of the provisions of the constitution.

BOND RESOLUTION OF THE TOWN OF NEWSTEAD, NEW YORK, ADOPTED JANUARY 26, 2009, AUTHORIZING THE JOINT ACQUISITION OF A PARCEL OF LAND LOCATED AT 12831 CLARENCE CENTER ROAD FOR THE PROPOSED TOWN OF NEWSTEAD/VILLAGE OF AKRON JOINT HIGHWAY FACILITY, STATING THE ESTIMATED MAXIMUM COST THEREOF IS $200,000, APPROPRIATING $100,000 FOR THE TOWN’S SHARE OF SUCH COST, AUTHORIZING THE ISSUANCE OF $100,000 SERIAL BONDS OF SAID TOWN TO FINANCE SAID APPROPRIATION, AND STATING THAT THE BALANCE OF THE COST IS EXPECTED TO BE PAID AND/OR FINANCED BY THE VILLAGE OF AKRON
The object or purpose for which the bonds are authorized is the joint acquisition of a parcel of land located at 12831 Clarence Center Road for the proposed Town of Newstead/Village of Akron joint highway facility at the estimated maximum cost of $200,000.
The amount of obligations to be issued is $100,000. It is expected that the balance of the cost shall be paid and/or financed by the Village of Akron.
The period of probable usefulness applicable to the object or purpose for which said $100,000 serial bonds are authorized to be issued is thirty (30) years pursuant to Section 11.00 a. 21 of the Law; however, the bonds authorized pursuant to this resolution and any bond anticipation notes issued in anticipation of the sale of said bonds, shall mature no later than five (5) years after the date of original issuance of said bonds or notes.
A complete copy of the Bond Resolution summarized above shall be available for public inspection during normal business hours at the office of the Town Clerk, Town Hall, 5 Clarence Center Road, New York.
