NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Newstead, in the County of Erie, State of New York, will meet at the Newstead Fire Hall, 5691 Cummings Road, Newstead, New York, at 7:00 o'clock P.M. (Prevailing Time), on November 9, 2009 for the purpose of conducting a public hearing to consider the proposed consolidation of Water District Numbers. 1, 2, 3, 4, 5, 6, 7, 7A, 8, 9, and 10 in the Town pursuant to Sections 206 and 206-a of the Town Law for the purposes of simplifying bookkeeping and budgeting, spreading the cost of future expansions and repairs across all districts, sharing of revenues by all districts and spreading future costs of operation and maintenance but each existing water district shall be responsible for payment of outstanding debts of that water district but shall retain the existing fund balances.

At said public hearing, the Town Board will hear all persons interested in said subject matter thereof.

PLEASE TAKE NOTICE, that there has been presented to the Town Board on October 13, 2009, for adoption a proposed Local Law to be known as "Local Law No. 3 of the Year 2009" entitled "Amendment to Article X of the Zoning Law of the Town of Newstead". The proposed Local Law will amend that portion of the Zoning Law dealing with home occupations to also address home based businesses and daycare operations.

THEREFORE, pursuant to the Municipal Home Rule Law Rules and Local Law No. 3 of the Year 2009, the Town Board of the Town of Newstead shall hold a Public Hearing on the aforesaid Local Law at the Town Hall, 5 Clarence Center Road, Akron, New York at 7:15 p.m. on the 26th day of October, 2009, at which time persons interested may be heard. Copies of the aforesaid proposed Local Law are available at the office of the Town Clerk for inspection and distribution to any interested person during business hours. The meeting room is wheel chair accessible. Those needing special arrangements should call the Town Hall at 542-4573 by October 21, 2009.

PLEASE TAKE NOTICE, that a public hearing of the Town Board will be held at Newstead Town Hall, 5 Clarence Center Road in the Village of Akron, New York at 7:55PM on the 26th day of October, 2009 to consider the following:

A request for rezoning approval from Niagara Specialty Metals, Inc. for the 2.13 acre parcel of land at 12526 Clarence Center Road, and a portion of the 32.43-acre parcel at 12566 Clarence Center Road (south of the bike path only) from RA to I2 for future expansion needs.

The hearing is open to the public. Interested individuals are invited to attend and may submit written comments in advance of the public hearing. The meeting room is wheelchair accessible. Those needing special arrangements should call the Town Hall at 542-4573 five days before the meeting date.

Public Hearing Notice

Notice is hereby given that the Tentative Budget of the Town of Newstead for the fiscal year beginning January 1, 2010 has been completed and filed in the Office of the Town Clerk at the Newstead Town Hall, 5 Clarence Center Rd, Akron, New York where it is available for inspection by any interested persons between the hours of 8:00 am and 4:30 pm.

Further notice is hereby given that the Town Board of the Town of Newstead will meet and review said Tentative Budget and hold a Public Hearing thereon, at the Newstead Town Hall at 7:45 pm on the 26th day of October, 2009 and that at such hearing any person may be heard in favor of or against the Preliminary Budget as compiled, or for or against any item or items therein contained.

The meeting room is handicapped accessible. Those needing special arrangements should call the Town Clerk at 542-4573 no later than October 20th, 2009.
