Regulations on Open Burning and Recreational Fires
With the warm weather upon us, it is important to remember that Section 307 of the New York State Fire Code regulates open burning and recreational fires.
This code section states that "Open burning that will be offensive or objectionable because of smoke or odor emissions when atmospheric conditions or local circumstances make such fires hazardous shall be prohibited.
This code section also regulates the locations that open burning may be conducted on a property relative to adjacent structures in the immediate area.
The code further requires that all fires must be constantly attended to until the fire is extinguished, and appropriate safety measures are implemented while burning takes place.
